Also, upon evacuating the premises, the defendant removed the stones, pulled out the shaft, and took the pump with him.

 

In doing so, he not only dragged the equipment through the shrubbery, but left the hole much larger than it was prior to his occupancy, making the property much less desirable to others. We, therefore, ask that judgment be granted."

Judge's provided  two options:

1)"Pay the balance $125 to the plaintiff, or
2) have the equipment detached from its current location and provide it to the plaintiff for damages."

The defendant wrote out a check immediately.

Peguam wanita menjawab, "klien saya bersetuju jikalau defendan tidak mencari  telaga pada hartanya dan defendan tidak diketahui bahawa lubang wujud, dia tidak akan sewa harta itu. Juga, apabila memindahkan premis, defendan mengeluarkan batu, ditarik keluar aci (zakar), dan mengambil pam dengan dia. Dalam berbuat demikian, beliau mengheret peralatan melalui Belukar, meninggalkan lubang yang lebih besar daripada sebelum itu dan membuat harta itu kurang wajar kepada orang lain. Oleh itu kami meminta penghakiman diberikan. "
